The most important principle of the KYNK Shop: KYNK is a marketplace intermediary. It is not the seller of any product listed in the Shop. The contract of sale for any product purchased through the Shop is strictly between the buyer and the vendor. KYNK is not a party to that contract.
1 Introduction and Purpose
1.1 About This Policy
This is the Marketplace and Seller Policy of [KYNK Legal Entity Name] ("KYNK", "we", "us", "our"). It governs the operation of the KYNK Shop — the marketplace feature available within the KYNK platform — and sets out the rights, responsibilities, and obligations of everyone who participates in it, whether as a seller, a prospective seller, or a buyer.
This Policy applies to all individuals who hold approved seller status on the KYNK platform ("Sellers" or "Vendors"), all individuals who apply for seller status ("Applicants"), and all verified KYNK users who purchase or attempt to purchase products through the Shop ("Buyers").
By applying for seller status, activating seller status, listing a product in the Shop, or making a purchase through the Shop, you confirm that you have read, understood, and agreed to be bound by this Policy.
1.2 What the KYNK Shop Is
The KYNK Shop is a curated, specialist marketplace embedded within the KYNK platform. It is a dedicated space where independent vendors operating within the kink, BDSM, and adult lifestyle sector can list products for sale to KYNK's community of verified adult members.
The Shop is not a general-purpose e-commerce platform. Products listed in the Shop must be relevant to the adult lifestyle community. The community relevance requirement is a genuine and actively applied standard — products that have no meaningful connection to the adult lifestyle community will not be approved for listing.
Access to the Shop as a Buyer is restricted to users who hold a verified KYNK account. Access as a Seller requires a separate application and approval process.
1.3 Relationship to Other KYNK Documents
This Policy forms part of the contractual framework between KYNK and its users, alongside the KYNK Terms of Service. Sections 15 and 16 of the Terms of Service establish the foundational legal framework for the Shop and for payments. This Policy expands on those provisions in detail. In the event of any conflict between this Policy and the Terms of Service, the Terms of Service shall prevail.
2 KYNK's Role — Marketplace Intermediary
KYNK operates the Shop as a marketplace intermediary. KYNK provides the platform, the infrastructure, the application and approval process, and the governance framework within which Sellers and Buyers transact. KYNK is not a retailer, trader, or merchant in respect of any product listed in the Shop by a third-party Seller.
KYNK does not manufacture, source, stock, warehouse, or fulfil any product listed by a Seller. KYNK does not set the price of any product. KYNK does not take commercial responsibility for the quality, safety, fitness for purpose, legality, accuracy of description, or delivery of any product.
The contract of sale for any product purchased through the Shop is made directly and exclusively between the Buyer and the Seller. KYNK is not a party to that contract. This principle applies regardless of the fact that KYNK provides the platform through which the transaction takes place or processes the payment.
KYNK's review and approval of product listings does not constitute an endorsement, guarantee, or warranty of any product. Approval of a listing means only that the listing met KYNK's standards at the time of review.
Buyers who have concerns or complaints about a product or a transaction should contact the Seller in the first instance. KYNK does not administer refunds on behalf of Sellers and is not financially responsible for any Seller's commercial obligations to Buyers.
3 Becoming a Seller
Verified KYNK users in good standing may apply to become vendors in the Shop, subject to KYNK's review and approval process. By listing products in the Shop, a vendor confirms that they have read, understood, and agreed to these Terms and the Marketplace and Seller Policy, and accepts the full obligations and responsibilities set out in this Policy.
KYNK reserves the right to approve or decline any vendor application at its discretion and to revoke vendor access at any time where a vendor fails to comply with these Terms or this Policy.
Vendor access is conditional on the vendor's continued compliance with these Terms and this Policy. KYNK may suspend or permanently terminate a vendor's access to the Shop at any time where the vendor fails to meet the standards set out here.
4 Seller Responsibilities
Vendors bear sole and complete responsibility for their products, their listings, and their conduct in the Shop. By listing products in the Shop, you as vendor represent, warrant, and agree to the following:
Product Legality and Safety
All products you list must be legal to sell and possess in your jurisdiction and, to the best of your knowledge, in the jurisdictions of your likely buyers. Products must be safe for their intended use, manufactured and supplied in compliance with all applicable laws and standards, and free from any material defect that could cause harm.
Accurate and Complete Listings
Every product listing must contain a clear and accurate description of the product including materials, dimensions, functionality, and intended use; accurate pricing including all applicable fees and taxes; accurate shipping information and delivery timelines; relevant safety information and usage instructions; and accurate images that genuinely represent the product being sold.
Adult Lifestyle Products Only
All products listed must be relevant to and appropriate for the kink, BDSM, leather, or alternative lifestyle community, intended for adult use only, and not marketed to or appropriate for minors in any way.
Consumer Data Protection
Where you collect personal data from buyers in connection with transactions, you must handle that data in accordance with all applicable data protection laws. You must collect only the data necessary for fulfilling the transaction, not use buyer data for marketing or any other purpose without the buyer's explicit consent, and implement appropriate security measures to protect buyer data.
Intellectual Property Compliance
All products and all listing content must respect the intellectual property rights of third parties. You may not list counterfeit or pirated products, products that infringe any third-party intellectual property right, or products that misrepresent their brand, origin, or authenticity.
Tax Compliance
You are solely responsible for determining, collecting, reporting, and remitting all taxes applicable to your product sales through the Shop. KYNK does not provide tax advice and does not assume any responsibility for your tax obligations.
5 Product Listing Standards
When creating a product listing on the Shop, you must provide all information required by the listing process, including:
- A clear, accurate product name and description
- Accurate pricing, including all applicable taxes and fees
- Accurate shipping costs and delivery timeline estimates
- Relevant safety information, usage instructions, and warnings
- Accurate images that genuinely represent the product
- Any age restrictions or eligibility requirements for the product
- Your stated refund and returns policy
You must update your listings promptly if any information changes. KYNK reserves the right to review product listings before they are published, to require changes to listings that do not meet these standards, and to decline to publish or remove any listing that violates this Policy.
6 Prohibited Products
The following categories of products are absolutely prohibited in the Shop with no exceptions. Listings of prohibited products will be removed immediately and may result in permanent termination of your seller account.
- Illegal products — any product whose sale, possession, or use is illegal under applicable law in the vendor's jurisdiction or in the likely jurisdictions of buyers
- Products harmful to or depicting minors — any product designed for, marketed to, or appropriate for minors; or any product that contains, depicts, or in any way involves minors in a sexual context. This is an absolute prohibition with no exceptions.
- Counterfeit and pirated products — any product that is counterfeit, pirated, fraudulently branded, or misrepresents its origin or authenticity
- Weapons and dangerous items — firearms, ammunition, explosives, and any items regulated as weapons under applicable law, or whose primary purpose is to cause harm to persons
- Controlled substances and pharmaceuticals — controlled substances, prescription pharmaceuticals, illegal drugs, and any regulated substances whose sale requires a licence the vendor does not hold
- Non-consensual content products — any product that contains, depicts, or facilitates non-consensual content of any kind
- Human trafficking and exploitation products — any product or service that facilitates, promotes, or enables human trafficking, sexual exploitation, or any form of modern slavery
- Products not relevant to the community — products that are not relevant to or appropriate for the kink, BDSM, leather, or alternative lifestyle community
- Payment processor prohibited products — any product that falls within the prohibited business or product categories of KYNK's payment processing partners
7 Pricing, Fees and Payouts
Vendors set their own product prices. KYNK deducts an applicable marketplace commission or processing fee from each transaction before disbursing the remaining amount to the vendor. The specific commission rates and processing fees applicable to your seller account are communicated to you during the seller onboarding process and may be updated from time to time with reasonable advance notice.
Payouts to vendors are processed in accordance with the payout schedule communicated during seller onboarding. KYNK reserves the right to withhold payouts where there is a reasonable basis to believe that a transaction is fraudulent, in dispute, or in violation of this Policy.
Vendors are solely responsible for all taxes applicable to their product sales. KYNK may be required by applicable law to collect, retain, or report certain tax-related information about transactions conducted through the Platform.
8 Order Fulfilment
Once a buyer has completed a purchase from your listing, you are obligated to fulfil that order in accordance with the terms described in your listing — including delivering the product within the stated timeframe, in the described condition, and at the agreed price.
You must communicate promptly with buyers regarding the status of their orders, including any delays or issues that arise after purchase. Where fulfilment is not possible — for example because a product is out of stock — you must notify the buyer promptly and arrange a refund.
KYNK reserves the right to take enforcement action against vendors who repeatedly fail to fulfil orders as described in their listings.
9 Refunds, Returns and Disputes
Vendor Refund Obligations
You are responsible for establishing and communicating a clear refunds and returns policy for your products before buyers make a purchase. You must handle refund and return requests from buyers in a fair, timely, and legally compliant manner in accordance with your stated policy and applicable consumer protection law.
Buyer Refund Requests
All refund and return requests must be directed to the vendor in the first instance, in accordance with the vendor's stated policy. KYNK is not the refunding party for Shop transactions. Where a vendor is unresponsive to a legitimate refund request, buyers may contact KYNK at [support@kynk.com] for assistance in facilitating communication with the vendor. KYNK is not obligated to provide refunds on behalf of vendors.
Disputes Between Buyers and Vendors
KYNK will not mediate disputes between buyers and vendors arising from Shop transactions. Where a dispute cannot be resolved between the buyer and the vendor directly, the parties may pursue their respective legal remedies under applicable consumer protection and contract law.
Chargebacks
Where a buyer initiates a chargeback in connection with a Shop transaction, KYNK may temporarily withhold the relevant payout to the vendor pending resolution of the chargeback investigation. Vendors who repeatedly attract chargebacks may have their seller access suspended or terminated.
10 Buyer Responsibilities
Users who purchase products through the Shop accept the following responsibilities:
- Personal use only — purchases are for your own personal use only. You may not purchase products for commercial resale or redistribution without KYNK's express prior written authorisation
- Legal eligibility to purchase — you are responsible for ensuring you are legally permitted to purchase and possess the products you order under the laws applicable to you in your jurisdiction
- Accurate transaction information — you must provide accurate, complete, and current information in connection with all purchases, including accurate delivery addresses and valid payment information
- Completed transactions — once you have submitted an order and payment has been confirmed, you are committed to completing that transaction. You must not submit orders you do not intend to complete
- Refund and return requests — all refund and return requests must be directed to the vendor in the first instance in accordance with the vendor's stated policy
11 Data Protection for Sellers
Vendors have independent data protection obligations in respect of buyer data they handle directly. These obligations are separate from and in addition to KYNK's obligations under the Privacy Policy.
Where you collect personal data from buyers — including contact details, delivery addresses, and payment information — you must:
- Collect only the data that is necessary for the legitimate purposes of fulfilling the transaction
- Not use buyer data for marketing, commercial, or any other purpose beyond fulfilling the transaction without the buyer's explicit consent
- Not share buyer data with third parties without the buyer's explicit consent
- Implement appropriate security measures to protect buyer data from unauthorised access or disclosure
- Handle all buyer data in accordance with all applicable data protection laws in your jurisdiction and in the jurisdictions of your buyers
KYNK recognises that buyer purchase history in the Shop may reveal aspects of a buyer's identity, lifestyle, or personal interests. Vendors must treat buyer data with the highest level of discretion and must never use buyer data in a way that could compromise a buyer's privacy or safety.
12 Enforcement and Suspension
KYNK reserves the following rights in connection with the Shop:
- Listing review and approval — KYNK may review any product listing before it is published and may require changes before publication
- Listing removal — KYNK may remove any product listing at any time, without prior notice, where it determines that the listing violates this Policy or poses a risk to the Platform
- Vendor suspension and termination — KYNK may suspend or permanently terminate a vendor's access to the Shop at any time where the vendor fails to comply with these Terms or this Policy
- Notice and takedown — KYNK operates on a notice and takedown basis for complaints about listings. If you believe a listing violates this Policy or infringes your intellectual property rights, you may submit a notice to KYNK at [legal@kynk.com]
KYNK's exercise of these rights does not constitute an assumption of responsibility for vendor listings or products and does not affect the allocation of liability set out in Section 13.
13 Limitation of Liability
KYNK makes no warranty, representation, or guarantee in relation to any product listed in the Shop by a third-party vendor, including the quality, safety, fitness for purpose, or legality of any product; the accuracy or completeness of any product listing; the identity, reliability, or trustworthiness of any vendor; or whether any product will be delivered as described or at all.
KYNK is not responsible for and expressly disclaims all liability in connection with products sold by third-party vendors through the Shop, including any harm, loss, injury, or damage arising from the purchase, use, or possession of any such product.
Vendors agree to defend, indemnify, and hold harmless KYNK and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses arising from or in connection with their products, their product listings, their conduct as a vendor, or any breach of these Terms or this Policy.
Nothing in this Section excludes KYNK's liability for its own gross negligence or wilful misconduct, or any liability that cannot lawfully be excluded under applicable consumer protection law.
